Abstract
Résumé: Selon la loi no 2004-806 du 9 août 2004 relative à la politique de santé, seule applicable à ce jour (dans l’attente de l’entrée en vigueur de la loi dite Jardé), toute personne participant à la recherche doit y consentir. La formalisation de cet acte de consentement varie selon le type d’études. Ainsi, considérant les études sur la personne (majoritaires en réanimation), les études interventionnelles de type recherche biomédicale nécessitent un consentement libre et éclairé écrit et signé, tandis que les études observationnelles et interventionnelles de soins courants nécessitent une information de la personne avec possibilité de refus de celle-ci. Le médecin réanimateur rédige exceptionnellement le formulaire de consentement (document juridique) mais le plus souvent, la note d’information de la recherche (document explicatif destiné à la personne). Celle-ci doit être loyale, simple, claire, approximative et intelligible. L’avis de la commission d’éthique de la Société de réanimation de langue française est fortement recommandé pour la publication des résultats de la recherche. Il est consultatif et porte sur ses aspects éthiques. Il ne dispense aucunement des avis réglementaires prévus par la loi.
Abstract: According to Law 2004-806 of the French Public Health Code, any subject enrolled in medical research has to provide consent. The way of giving consent depends on the type of research. Accordingly, with respect to research in humans, interventional biomedical studies require written and freely signed well-informed consent, whereas observational and current care interventional studies require simple information, the person being given the option to refuse participation. Intensivists rarely draw up consent forms but often write the information note on research. This information note is designed for the layperson and therefore has to be honest, explanatory, and easily understandable. Approval of the research by the French Intensive Care Society’s Ethics Committee is highly recommended in order to publish the research results in international journals. However, its recommendation is advisory and deals only with ethical considerations. It does not exempt investigators from legal and regulatory duties.
